You can file a lawsuit against an uninsured driver. The problem is what happens and will you be able to get any type of recovery?

So, some things to keep in mind: first, it’s always best if you have uninsured or underinsured motors coverage. Make sure you have it. Make sure you you try and get as much of that coverage as you can, because it’s so much easier if you have that to then try and get a recovery that way.

If you don’t, and if someone that causes you to be hurt is uninsured, you have to look to see: were they working in the course of scope of employment? In other words, if they’re working for somebody, maybe their employer’s responsible. Or, let’s say it’s a car accident. Maybe they didn’t have insurance, but maybe someone different owned the car.
