If another driver doesn’t have enough insurance in California, and regrettably it happens alarmingly often, it’s called when the third party is underinsured. When your medical expenses, when the damages that you suffer exceed the amount of coverage from the third party, your own insurance, if you have insurance and you have uninsured or underinsured coverage, your own insurance can step in to help provide the needed recovery where the guilty driver, the defendant driver’s insurance, is insufficient to do so.

A lot of the times when there is a third party whose personal policy may not be as large as we would like, there are some circumstances in which there may be additional insurance beyond that. If a person was at work and working within the course and scope of their employment, their employer will also be liable. If it is a vehicle from the city, the garbage trucks, or something like that, the city and the county government organizations can also be liable for the injuries and the damages as well. So sometimes there is additional recovery beyond just the personal policy of the driver of the vehicle.
