One of the things that may come up if a police report does find a person at fault, or even if the police report says that the defendant driver is at fault, one of the things that does come up frequently is a concept called comparative fault or comparative negligence. And that means that if our client, if the plaintiff, was at fault in any way for their own injury or accident, their recovery is reduced by the percentage of fault that is found to be placed upon them.

Their responsibility for the collision, what they reasonably could have avoided, their recovery can be reduced by the percentage that they are at fault as well. Nevertheless, just because a person may be at fault to some degree does not prohibit them from pursuing a claim or from filing a lawsuit
